FENTHION VOLUNTARY CANCELLATION REQUESTED

On May 30, EPA issued a Federal Register notice announcing receipt of
a request from registrant Bayer Environmental Science for voluntary
cancellation of their organophosphate pesticide fenthion, used
primarily
for adult mosquito control in two counties in Florida. The Agency
will accept public comment on the proposed cancellation of all uses
of fenthion until July 29.

The effective date of the cancellation order will be June 30, 2004,
unless the Agency receives substantive comments during the comment
period that merit its further review of Bayer's request. Distribution
or
sale of products listed in this notice will be prohibited after June
30, 2004, except for return of unused portions to Bayer or for proper
disposal. EPA expects use of products listed in this notice will be
permitted until November 30, 2004. Any such use must be in accordance
with the product label. Bayer has submitted label amendments
intended to reduce the risks of fenthion. During the next two use
seasons, amended product labeling will include revised use directions
specifying safer spray methods and requiring steps to enhance
protection of
endangered species. These mitigation measures are expected to help
reduce avian exposure during the phase-out period. Because Bayer has
requested cancellation of the registrations for all of its fenthion
products, Bayer is not required to satisfy the data requirements in
any of the Agency's Data Call-Ins.
